Wednesday, 5 February: Basel vs. St. Gallen – Green Energy in the Spotlight

A new day, another showdown at the Moot Court Trial Runs at Prager Dreifuss! Today, the team of the University of Basel takes on the representatives of University of St. Gallen. The case revolves around pressing issues in the green energy sector: contracts between private companies and state-owned enterprises, the limits of confidentiality, admissible evidence, and the ever-persistent question – when is termination justified on important grounds, and when is it just a matter of convenience?

The St. Gallen delegation, represented by Dominic Rode (procedural questions) and Kara Ölke (substantive questions), immediately goes on the offensive: does the arbitral tribunal have jurisdiction? What about the mediation that should have been pursued first? But the team from Basel – with Nicolas Manohar (procedural questions) and Tessa Borer (substantive questions) – swiftly counters: which laws govern these questions and what about the contentious e-mails by the in-house counsel?

It's a battle of sharp arguments, deep analysis, and a touch of charisma. The arbitral tribunal, composed of Marcel Frey (presiding), Gion Jegher, and Bernhard Lauterburg, faces strong positions. In their individual feedbacks the participants gain valuable insights to legal and other aspects of their presentations, matters to discuss in more detail over some drinks at the aperitif ending off the evening.
