Mike Abegg's PhD thesis focuses on the legal position of the injured party under substantive and procedural law if the injured party wishes to take action against the solvent liability insurer due to an insolvent tortfeasor. For example, the new direct right of claim introduced with the revision of the Insurance Contract Act (ICA) and the injured party's existing statutory pledge are examined. The construction of a direct substantive or procedural legal relationship between the injured party and the liability insurer by means of general legal institutions is also the subject of the investigation wherever no direct right of claim is available to the injured party.
